Welcome to Keklckqva. By accessing and using our platform, you accept these Terms and Conditions. Please read them carefully.
1. Definitions
"Platform" refers to the website keklckqva.com and all related services. "User" refers to any person who accesses or uses the Platform. "Investor" refers to registered users who participate in crowdlending opportunities. "Project" refers to real estate investment opportunities available on the Platform.
2. Eligibility
To use our Platform you must: be at least 18 years of age; be a legal resident of Ecuador or have legal capacity to invest from your jurisdiction; provide truthful and current information; and comply with all applicable laws and regulations.
3. Registration and Account
To invest, you must create an account providing accurate information. You are responsible for maintaining the confidentiality of your access credentials. You must notify us immediately of any unauthorized use of your account.
4. Crowdlending Services
Keklckqva facilitates the connection between investors and real estate projects. We do not guarantee specific returns. All investment carries risks, including possible loss of invested capital. Past returns do not guarantee future results.
5. Investment Risks
Real estate crowdlending involves significant risks: developer default risk; real estate market risk; liquidity risk (investments are not easily liquidable); and regulatory risk. We recommend diversifying your investments and not investing more than you can afford to lose.
6. Fees and Payments
Applicable fees are detailed in each project. Interest payments are made according to the schedule established in each project. Keklckqva is not responsible for delays caused by the project developer.
7. Intellectual Property
All content on the Platform, including texts, graphics, logos, images and software, is owned by Keklckqva or its licensors and is protected by intellectual property laws.
8. Limitation of Liability
Keklckqva acts solely as an intermediary. We do not guarantee the accuracy of information provided by developers. Our maximum liability is limited to the amount of fees paid by the user.
9. Termination
We may suspend or terminate your access to the Platform for violation of these Terms or for any other reason at our discretion. Active investments will continue under their original terms.
10. Applicable Law
These Terms are governed by the laws of the Republic of Ecuador. Any dispute shall be resolved in the courts of Quito, Ecuador.
11. Modifications
We reserve the right to modify these Terms at any time. Changes will take effect upon posting on the Platform. Continued use of the Platform constitutes acceptance of the modified Terms.
